HIV positive Terre Haute woman arrested for sexual misconduct with a minor

VIGO COUNTY, Ind. (WTHI) – A West Terre Haute woman was arrested over the weekend for charges including sexual misconduct with a minor.
The Vigo County Jail Tracker shows Lisa Custer, 21 of West Terre Haute, was arrested on Saturday just before 5 p.m.

Her charges include sexual misconduct with a minor as well as failure to comply/recklessly violates or fails to comply with law on reporting some communicable disease.

According to court documents, on May 19, 2014, as part of a separate investigation, Custer was interviewed. Detectives learned, she had previously submitted both the oral and confirmatory blood tests for HIV and tested positive in both. Custer signed a duty to warn upon receiving those results.

According to the probable cause, Custer met D.M. (a 15-year-old minor) after she began dating his father, T.E.

D.M. stated that Custer began staying at the residence and they began to get close. D.M. said that things progressed, and that Custer began to tell him that she wanted to have sex with him.

D.M. stated, Custer did not tell him about that she had HIV until two days after their sexual encounter.

The Vigo County Prosecutor’s Office tells News 10, they became aware of Custer when a report was made to their office during the Benford investigation. Due to the nature of the allegations, they immediately contacted Indiana State Police.

“The fact still remains, that anytime you have one person that’s infected and they’re not warning others, then they’re probably not taking the necessary precautions to prevent that spread. We certainly don’t want to have one of those major outbreaks here in Vigo County,” said Rob Roberts, Chief Deputy Prosecutor.

Custer’s bond was set a $20,000 with cash only and no 10 percent allowed.

Her trial is scheduled for August 21st.
